By becoming an HTA member using, and posting on this site, and choosing to ride any trail or location, you agree to the following terms...

Membership Agreement

Membership Agreement

This membership agreement ("Agreement") is entered into by HTCAA dba HTA and you as you use this site and purchase or sign up to be a member ("Member"). Our membership, website and forums are open to public access for individuals over the age of 18 once users make a login ID or purchase a membership at HorseTrailsofAmerica.com.

 

Member benefits.

Membership to the association includes benefits for each tier of belonging. Membership offerings are listed and updated on the Member Benefits Page and include different levels of access for Free Access, Trail & Travel or Comprehensive members.

Membership dues.

Member dues are paid on an annual basis. Free Access members do not have dues but must sign up online and agree to the remaining terms. Trail & Travel membership is $44.95 per year. Comprehensive membership is $74.95 per year. Once a membership is purchased, it is good for the entire year and may not be canceled until the end of the term. No refunds will be given for partial-year memberships. If a free-trial is granted, the Member is responsible for any fees after the trial ends.

Restrictions

Membership to the association and site at any level is voluntary and means that users agree to the following terms.

  • The Member agrees that they will not share login information with non-members.

  • The Member agrees not to reproduce any of the information received as part of membership and will not share with non-members.

  • The Member agrees to post and share truthful information that they have permission and rights to share.

 

Online interaction restrictions. 

  • Negative comments in posts in the forum or association social media groups will not be tolerated. This includes a restoration against arguments, name-calling, or profanity.  

  • Promotion of regulated goods like tobacco or pharmaceutical drugs will not be tolerated.

  • Discussion of self-harm, suicide, or eating disorders will not be tolerated.

  • Sexually suggestive or sexually explicit content will not be tolerated.

  • Depictions of violence will not be tolerated.

  • Harassment of other members will not be tolerated.

  • Anything posted or shared by a Member is the Member's own thoughts and is not the view of HTA. 

If any member doesn't adhere to these rules, HTA has the right to remove members from the website, membership, or any group activity.  

The Member will not hold HTCAA, HTA liable for any tangible or intangible damage that might happen to them while participating in the membership online or in person. In addition, all Members agree that horse riding is a risk and Members all ride at their own risk.

 

Any information learned on the HTA sites, literature, publications, posts, or any form of communication must be treated as entertainment and the use of anything shared is at the discretion, choice and liability of the Member.

Riding and Horse Release

HTCAA (dba Horse Trails of America, HTA)

 

Release and Waiver of Liability and Indemnity Agreement with the knowledge that the Member is undertaking to walk, trot, canter, ride and control a horse, on natural or rough terrain, an inherently dangerous activity, and the HTA Member:

 

  1. HEREBY RELEASES, WAIVES, DISCHARGES and COVENANTS NOT TO SUE HTCAA (DBA HORSE TRAILS OF AMERICA, HTA), individually, and doing business as HTA named officers, contractors, employees, workers, volunteers, affiliated clinicians, and each of them (hereafter referred to as RELEASEES) from all liability to the Member, their personal representatives, assignees heirs, and next of kin for any and all loss or damage, and any claim or demands therefore on account of injury to the Member person, the person’s horse, or any type of activity or resulting in the death of the Member, whether caused by the negligence of the RELEASEES or otherwise while the Member is walking, riding or standing in proximity to (Whether under the instruction or supervision of  RELEASE or not) any horse on property, (whether owned by the RELEASEES or not).

  2. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the RELEASEES and each of them from any loss, liability, damage, or cost they may incur due to the inherently dangerous activity described herein, whether caused by the negligence of RELEASEES or otherwise.

  3. HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE INCLUDING ANY DAMAGE TO AN ANIMAL due to negligence of RELEASES, or otherwise participating in the inherently dangerous activities described herein.

  4. THE MEMBER EXPRESSLY ACKNOWLEDGES AND AGREES THAT THE ACTIVITIES UNDERTAKEN BY THE MEMBER AS CONTEMPLATED ABOVE ARE DANGEROUS and involve the risk of serious bodily injury and/or death and/or property damage. The Member further expressly agrees that the foregoing Release, Waiver and Indemnity Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that if any portion hereof is held invalid, then the remainder of this Release, Waiver and Indemnity Agreement shall, notwithstanding, continue in full force and effect.

  5. THE MEMBER HAS READ AND VOLUNTARILY SIGNED THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and expressly acknowledges that no insurance coverage of any kind is to be provided, included or guaranteed by RELEASES. The Member expressly acknowledges that no oral representations, statements or inducements apart from the foregoing written agreement have been made.

  6. WARNING: UNDER TEXAS LAW, AN EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES, PURSUANT TO TEXAS CODE CHAPTER 87.
